These terms are the agreement between CheapServ ("we", "us") and you, the account holder, for every service sold on cheapserv.com: VPS, dedicated servers, GPU servers and Windows RDP. By creating an account or placing an order you accept them, together with the Acceptable use policy, the Privacy policy, the Service level agreement and the Refund policy. Where those documents are more specific, they take precedence over this page.
1. Who we are and what this covers
CheapServ is an independent hosting provider. We own the servers, switches and spare parts in each of our six locations (Frankfurt, Amsterdam, Helsinki, New York, Los Angeles and Singapore) and rent rack space, power and cross-connects in each facility. We sell infrastructure only: you decide what runs on it, and you remain responsible for it.
These terms apply to the website, the customer dashboard, the API and every server you order. They do not cover software you install, content you host or services you offer to your own users.
2. Your account
- An account needs an e-mail address and a password. We never ask for identity documents, a phone number or a payment card. You confirm that you are at least 18 years old and that you are not prevented by law from buying hosting services.
- You are responsible for everything done with your account and its API keys. Keep your password and keys private; API keys are shown once and cannot be recovered afterwards, only revoked. Tell us at once through a ticket if you suspect unauthorised access.
- There is no password reset by phone or by identity check. Recovery is only possible through the e-mail address on the account, so keep that mailbox secure and up to date.
- One person or one organisation per account. You may run as many servers as you like under it. Reselling is allowed, but you remain our only contact and you answer for your customers' use of the service.
3. Services and provisioning
Each plan is described on its product page and in the order summary: CPU, memory, storage, port speed, traffic allowance and location. Prices are in USD and are the same in every location.
- Servers are provisioned automatically after payment confirmation, usually within 60 seconds. This applies to every product, including dedicated servers marked as in stock.
- Custom dedicated builds are quoted individually and take up to 3 business days.
- Stock is shown live. A plan marked "Sold out" cannot be ordered until capacity is back; we do not take pre-orders.
- We may replace hardware with equivalent or better hardware at any time, for example when repairing a failure or refreshing a location.
4. Payment, balance and renewals
- We accept cryptocurrency only: Bitcoin, Ethereum, Monero and Tether (USDT on TRC-20 or ERC-20). We do not accept cards or bank transfers.
- Your account holds a prepaid balance in USD. Orders and renewals are paid from that balance; the minimum top-up is $5. The balance never expires.
- When an invoice is created, the crypto amount is locked for 30 minutes. If a payment arrives late, or for a different amount, it is credited to your balance at the amount actually received.
- Every plan renews monthly from your balance. We send reminders 7 days and 2 days before each renewal. Nothing is ever charged beyond your balance, and there are no overage fees: VPS and RDP traffic is throttled to 100 Mbps once the monthly allowance is used up, never billed.
- If the balance is insufficient on the renewal date, the server enters a 3-day grace period, then is suspended. A suspended server that remains unpaid is deleted 14 days after suspension, together with its snapshots. Deleted data cannot be recovered.
- Prices can change for new orders. Running servers renew at the price you ordered them at for as long as they stay active.
5. Cancelling and refunds
You can cancel any server from the dashboard at any time. A cancelled server stays online until the end of its paid month and is then deleted. There is no pro-rata refund of a running month, but when you upgrade or migrate a server within CheapServ the unused days are credited to your balance.
Unused prepaid balance is refundable to your wallet within 14 days of the top-up, minus network fees, in the same cryptocurrency at the USD rate at the time of refund. The full rules are in the Refund policy.
6. Acceptable use, your data and backups
- Your use of the service must comply with the Acceptable use policy. We may suspend or terminate a server, or an account, that breaches it.
- Your data stays yours. We do not access the contents of your servers except to the extent needed to operate the service, to respond to a valid abuse report or to comply with a legal obligation.
- You are responsible for your own backups. VPS plans include two manual snapshots; optional daily backups with 7-day retention can be added for 20% of the plan price. Data on a deleted or expired server is not kept.
7. Availability, support and hardware
We commit to 99.99% monthly availability of network and power under the Service level agreement. Service credits are your remedy for downtime and are added to your balance. On dedicated servers, a failed disk, memory module or power supply is replaced within 4 hours from the spare pool kept in each location.
Support is provided by ticket from /support and by e-mail at [email protected]. Support covers the infrastructure we sell: hardware, network, provisioning, billing and the dashboard. It does not cover the administration of your operating system or software, although we will point you in the right direction when we can.
8. Liability, termination and governing law
- The service is provided as described on the product pages. Beyond the commitments in the Service level agreement we give no other warranty, and we do not warrant that the service will suit a particular purpose.
- To the extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid for the affected server in the 3 months before the event. We are not liable for lost profits, lost data that you did not back up, or indirect damage.
- You will hold us harmless from claims by third parties arising from content you host or actions you take with the service.
- We may terminate the agreement for a serious or repeated breach of these terms or of the Acceptable use policy, for a legal requirement, or if we stop offering a product. Except in cases of breach, we give at least 30 days' notice and refund the unused balance.
- These terms are governed by the laws of CheapServ's country of establishment. If a clause is found unenforceable, the rest remains in force.
9. Changes to these terms
We may update these terms when the service or the law changes. The effective date at the top of this page is updated with every revision. Material changes are announced on /status and by e-mail at least 14 days before they apply. Continuing to use the service after that date means you accept the new terms; if you do not, cancel your servers before the change takes effect and request a refund of the unused balance.
